This Privacy Policy (“Policy”) sets out the terms governing the collection, use, processing, storage, disclosure and protection of Personal Data by MPRS Shipping & Logistics Private Limited, a company incorporated under the laws of India, having its registered office at 1207/1208, Ghanshyam Enclave, New Link Road, Near Laljipada Police Chowky, New Link Road, Kandivali West, Mumbai – 400067, Maharashtra, India (“MPRS”, “Company”, “we”, “us” or “our”), in connection with the MPRS Genie mobile application and associated services.
MPRS is committed to handling Personal Data responsibly, transparently and in accordance with applicable data protection and privacy laws.
By downloading, accessing, registering with, or using MPRS Genie (“Application” or “App”), you acknowledge that you have read and understood this Policy.
- SCOPE AND APPLICABILITY
- This Policy applies to the collection and processing of Personal Data through the MPRS Genie mobile application, including its versions made available for Apple iOS and Google Android devices.
- This Policy applies to Personal Data collected through or in connection with:
- registration and authentication of an MPRS Genie account;
- use of MPRS Genie and its features;
- shipment, booking, quotation and logistics-related services;
- submission or upload of documents and files;
- communications and requests submitted through the Application;
- Genie and other automated or AI-assisted functionality, when enabled;
- customer support and other interactions with MPRS relating to the Application;
- technical, security, diagnostic and operational activities associated with the Application.
- This Policy does not necessarily apply to personal information processed independently by third-party websites, applications, carriers, logistics providers or other external services that may be accessible through or integrated with MPRS Genie. Such parties may maintain their own privacy policies.
- DEFINITIONS
- For the purposes of this Policy:
- “Application” or “App” means the MPRS Genie mobile application, including its iOS and Android versions and any successor or replacement version.
- “Genie” means the digital, automated, artificial intelligence or machine-learning functionality made available through MPRS Genie from time to time.
- “Personal Data” means any information relating to an identified or identifiable individual, or such equivalent category of information recognised under applicable law.
- “Processing” includes collecting, recording, organising, storing, accessing, using, analysing, transferring, disclosing, modifying, deleting or otherwise handling Personal Data.
- “Service Provider” means any third party engaged by MPRS to provide hosting, infrastructure, technology, security, analytics, document processing, AI, customer support or other services.
- “User”, “you” or “your” means any person who accesses or uses MPRS Genie.
- INFORMATION WE COLLECT
- Depending upon your use of the Application and the functionality available to you, MPRS may collect and process the following categories of information.
- Account and Authentication Information
When you register for or access MPRS Genie, we may collect:
- name;
- registered mobile telephone number;
- email address;
- company or organisation information;
- authentication and account information; and
- information necessary to verify, maintain and secure your account.
Authentication may be performed using your registered mobile telephone number and/or email address.
- Business and Logistics Information
In providing MPRS services, we may process information relating to:
- shipments and consignments;
- cargo;
- bookings;
- quotations;
- bills of lading;
- invoices;
- packing lists;
- shipping instructions;
- consignors, consignees, notify parties and other and all transaction participants;
- ports, destinations and routing information;
- freight and logistics information;
- shipment status and tracking information; and
- other information necessary to provide, administer or manage MPRS services.
Such information may contain Personal Data relating to individuals associated with a shipment or transaction.
- Documents and Files
- MPRS Genie may permit you to select and upload documents and files from your device.
- These may include shipping, commercial, financial or logistics-related documents, including bills of lading, invoices, packing lists, quotations, shipping instructions, photographs, scanned documents and similar records.
- Documents uploaded through the Application may be processed for purposes including document review, information extraction, shipment processing, customer support, automated processing and other functionality requested by you.
- You represent that you have the necessary authority or lawful basis to provide documents or Personal Data relating to other individuals through the Application.
- Genie Inputs and User Content:
- Where Genie functionality is available, you may submit questions, instructions, prompts, text, documents or other content.
- Such submissions may contain Personal Data or confidential business information.
- MPRS may process such information to provide the functionality requested by you and to generate, facilitate or deliver a response.
- Technical and Device Information:
- Depending upon the Application configuration and technology used, we may collect certain technical information, including:
- device type and model;
- operating system and version;
- Application version;
- IP address;
- network information;
- device or Application identifiers where technically necessary;
- language and regional settings;
- authentication and security information; and
- error, crash and diagnostic information.
- Notifications:
- Where you enable push notifications, MPRS may process information necessary to deliver such notifications to your device.
- You may control notification permissions through your device settings.
- DEVICE PERMISSIONS
- MPRS Genie may request access to certain functions of your mobile device where such access is necessary to provide a particular feature.
- Files and Documents:
- The Application may request access to files or documents stored on your device so that you can select and upload information for shipment, logistics, document-processing or related functionality.
- Camera:
- Where a feature requiring document scanning, photography or image capture is introduced, the Application may request access to the device camera.
- The camera will be accessed only when the relevant functionality is initiated or otherwise permitted by the applicable operating system.
- Microphone:
- The current version of MPRS Genie does not require microphone access for voice input.
- A future version may introduce voice-enabled functionality. Where such functionality is introduced, the Application will request the relevant permission where required.
- Location:
- The current version of MPRS Genie does not require access to precise device location.
- A future version may introduce location-based functionality. Where such functionality is introduced, the Application will request the relevant permission where required.
You may manage or withdraw device permissions through your device’s operating-system settings. Certain features may not function if the relevant permission is denied.
- PURPOSES OF PROCESSING
- MPRS may process Personal Data for the following purposes:
- creating, maintaining and administering user accounts;
- authenticating users;
- providing MPRS shipping, logistics and related services;
- processing bookings, quotations and shipments;
- providing shipment and tracking information;
- processing documents submitted through the Application;
- responding to user requests;
- providing Genie and other automated functionality;
- providing customer support;
- maintaining Application functionality and security;
- preventing fraud, misuse and unauthorised access;
- detecting, investigating and resolving technical issues;
- monitoring and improving Application performance;
- complying with applicable legal and regulatory requirements;
- enforcing contractual rights and obligations; and
- protecting the rights, property and safety of MPRS, its users and other persons.
- MPRS shall not intentionally process Personal Data for purposes materially incompatible with those disclosed in this Policy unless permitted or required by applicable law or appropriate notice or consent has been provided.
- BASIS AND LEGITIMATE PURPOSE OF PROCESSING
- MPRS may process Personal Data where such processing is:
- necessary to provide services requested by you;
- necessary to perform or administer a contractual or commercial relationship;
- necessary to comply with applicable legal, regulatory or governmental requirements;
- necessary to protect the security, integrity and functionality of the Application and MPRS systems;
- necessary to prevent fraud, abuse or unlawful activity; or
- otherwise permitted or authorised under applicable law.
- Where applicable law requires consent for a particular processing activity, MPRS will obtain such consent in the manner required by law.
- MPRS GENIE AND ARTIFICIAL INTELLIGENCE
- MPRS may introduce artificial intelligence, machine-learning, natural-language processing, automation and related technologies into MPRS Genie.
- Where Genie functionality is enabled, information submitted by a User may be processed by MPRS and, where necessary, by third-party AI or technology Service Providers engaged by MPRS.
- Such information may include:
- prompts and questions;
- instructions;
- text entered into the Application;
- uploaded documents;
- information extracted from uploaded documents;
- shipment and logistics information; and
- other information voluntarily submitted in connection with Genie functionality.
- AI processing may be undertaken for purposes including generating responses, analysing information, extracting information from documents, assisting with logistics-related queries and providing other functionality requested by the User.
- MPRS will take reasonable steps to ensure that third-party AI Service Providers engaged by MPRS process information in accordance with applicable contractual, technical and legal requirements.
- MPRS does not intend to use Personal Data submitted through MPRS Genie for training general-purpose AI models operated by third-party AI providers, unless such processing is expressly disclosed to the User and permitted under applicable law
- Users acknowledge that AI-generated information may contain errors, omissions or inaccuracies. Genie is intended to provide assistance and information and should not be treated as a substitute for professional, legal, regulatory, customs, contractual, financial, shipping or other expert advice.
- Users remain responsible for independently verifying information before relying upon AI-generated information for any commercial, contractual, regulatory, shipping, customs or other consequential decision.
- RETENTION OF GENIE INPUTS AND OUTPUTS
- MPRS will retain Genie inputs, outputs and related information only for as long as reasonably necessary for the purpose for which such information was collected or processed.
- Depending upon the functionality implemented, Genie prompts and responses may be processed without being maintained as a permanent conversation history.
- Where the Application introduces functionality enabling Users to save, retrieve or access previous Genie conversations, such information may be retained for the period reasonably necessary to provide that functionality.
- MPRS may retain information for longer where necessary to:
- comply with applicable law
- comply with regulatory or governmental requirements;
- maintain required business or transaction records;
- resolve disputes;
- establish, exercise or defend legal claims;
- prevent fraud or security incidents; or
- otherwise fulfil a lawful purpose.
- DISCLOSURE AND SHARING OF PERSONAL DATA
- MPRS may disclose Personal Data where reasonably necessary for the purposes described in this Policy.
- Service Providers
- MPRS may engage third parties providing:
- cloud and hosting infrastructure;
- authentication services;
- application and software infrastructure;
- document processing;
- cybersecurity;
- technical support;
- customer support;
- analytics and diagnostics;
- AI and machine-learning services; and
- other technology or operational services.
- Logistics and Business Partners
- MPRS may share information with carriers, shipping lines, freight partners, agents, customs or regulatory service providers, vendors and other parties where necessary to provide or administer the relevant logistics services or transactions.
- Legal and Regulatory Disclosure
- MPRS may disclose Personal Data where required or permitted by applicable law, regulation, court order, governmental request or legal process.
- MPRS may also disclose information where reasonably necessary to establish, exercise or defend its legal rights or to prevent fraud, abuse, security threats or other unlawful activity.
- Corporate Transactions
- Personal Data may be transferred or disclosed in connection with a merger, acquisition, restructuring, financing, sale of assets or other corporate transaction involving MPRS, subject to applicable law.
- THIRD-PARTY SERVICES AND SOFTWARE DEVELOPMENT KITS
- MPRS Genie may incorporate third-party software development kits (“SDKs”), libraries, APIs or other third-party technologies.
- Such technologies may process limited information necessary to provide their functionality.
- MPRS will take reasonable steps to ensure that third-party providers engaged by MPRS handle Personal Data in accordance with applicable contractual and legal requirements.
- The third-party technologies used by the Application may change over time. Where such changes materially affect the processing of Personal Data, MPRS may update this Policy and the relevant privacy disclosures.
- ANALYTICS, DIAGNOSTICS AND TRACKING
- MPRS may use analytics, application-performance monitoring and crash-reporting technologies to maintain the security, stability and functionality of MPRS Genie and to identify and resolve technical issues.
- Where such technologies are used, MPRS will seek to limit collection to information reasonably necessary for the relevant purpose.
- MPRS Genie does not currently use advertising technologies intended to track Users across unrelated applications or websites for targeted advertising.
- MPRS does not sell Personal Data for monetary consideration.
- DATA SECURITY
- MPRS maintains reasonable technical and organisational safeguards designed to protect Personal Data against unauthorised access, use, alteration, disclosure, loss, destruction or misuse.
- Depending upon the nature of the information, such measures may include:
- authentication and access controls;
- role-based access restrictions;
- encryption during transmission;
- secure hosting infrastructure;
- security monitoring and logging;
- vulnerability management; and
- other safeguards appropriate to the nature and sensitivity of the information.
- Notwithstanding the foregoing, no electronic transmission, storage system or security measure can be guaranteed to be completely secure.
- Accordingly, MPRS does not warrant that Personal Data can never be accessed, disclosed, altered or destroyed through circumstances beyond its reasonable control.
- DATA RETENTION
- MPRS shall retain Personal Data only for so long as reasonably necessary for the purposes for which it was collected or otherwise processed.
- The applicable retention period may depend upon:
- the nature of the information;
- the purpose for which it was collected;
- the nature and duration of the relationship with the User;
- contractual requirements;
- applicable legal and regulatory requirements;
- accounting, taxation and record-keeping obligations;
- dispute resolution requirements; and
- legitimate security and fraud-prevention requirements.
- When Personal Data is no longer required, MPRS will take reasonable steps to delete, anonymise or securely dispose of such information, subject to applicable law and legitimate retention requirements.
- INTERNATIONAL DATA TRANSFERS AND PROCESSING
- MPRS may use technology, cloud infrastructure and Service Providers located outside India.
- Accordingly, Personal Data may be processed or stored in jurisdictions outside India.
- Where Personal Data is transferred internationally, MPRS will take reasonable steps to ensure that such transfer is undertaken in accordance with applicable law and that appropriate safeguards are implemented where required.
- USER RESPONSIBILITIES
- Users are responsible for ensuring that information submitted through MPRS Genie is accurate, lawful and relevant to the functionality or service being used.
- Users shall not knowingly upload or submit Personal Data relating to another individual unless they have the appropriate authority, permission or lawful basis to do so.
- Users should avoid uploading sensitive, confidential or Personal Data that is not reasonably necessary for the requested functionality.
- Users are responsible for maintaining the confidentiality of their authentication credentials and for notifying MPRS promptly if they suspect unauthorised access to their account.
- USER RIGHTS
- Subject to applicable law, Users may have rights relating to their Personal Data, including the right to:
- request access to Personal Data held by MPRS;
- request correction of inaccurate or incomplete Personal Data;
- request deletion of Personal Data;
- request information regarding the processing of Personal Data;
- withdraw consent where processing is based on consent;
- raise a grievance or complaint concerning the processing of Personal Data; and
- exercise any other rights available under applicable law.
- MPRS may require reasonable verification of identity before processing a request relating to Personal Data.
- MPRS may decline or limit a request where permitted or required by applicable law, including where retention is necessary for legal, regulatory, security, accounting, taxation, contractual or dispute-resolution purposes.
- ACCOUNT DELETION AND PERSONAL DATA DELETION
- Users may request deletion of their MPRS Genie account and associated Personal Data by contacting MPRS at:
- Requests should clearly identify the User and, where possible, the email address or mobile telephone number associated with the relevant MPRS Genie account.
- MPRS may require reasonable verification of the User’s identity before processing a deletion request.
- Upon receiving a valid deletion request, MPRS will take reasonable steps to delete the User’s account and Personal Data that MPRS is not required or legally permitted to retain.
- Certain information may be retained where necessary or permitted for purposes including:
- compliance with applicable law;
- accounting and taxation;
- regulatory requirements;
- fraud prevention;
- cybersecurity;
- dispute resolution;
- establishment, exercise or defence of legal claims; or
- other lawful purposes.
- Where information is required to be retained, MPRS will restrict its use to the purpose for which such retention is necessary.
- MPRS may try to introduce an in-Application account deletion mechanism or a direct link to an account-deletion facility in future versions of MPRS Genie.
- CHILDREN’S PRIVACY
- MPRS Genie is intended primarily for business and professional use and is not directed towards children.
- MPRS does not knowingly seek to collect Personal Data from children in circumstances where such collection is prohibited by applicable law.
- If you believe that Personal Data relating to a child has been provided to MPRS inappropriately, please contact us using the details provided in clause 22.
- THIRD-PARTY WEBSITES AND SERVICES
- MPRS Genie may contain links to or integrations with websites, applications, platforms or services operated by third parties.
- Such third-party services may be governed by separate privacy policies and terms.
- MPRS does not control and is not responsible for the privacy practices, security, content or policies of third-party services.
- Users are advised to review the applicable privacy policies before providing Personal Data to such third parties.
- CHANGES TO THIS PRIVACY POLICY
- MPRS reserves the right to amend or update this Policy from time to time to reflect:
- changes to MPRS Genie;
- introduction of new functionality;
- changes in technology;
- changes in data-processing practices;
- changes in applicable law or regulatory requirements; or
- other operational or business requirements.
- The updated Policy shall be published on the MPRS website together with the revised “Last Updated” date.
- Where required by applicable law, MPRS will provide additional notice or obtain consent in respect of material changes.
- Your continued use of MPRS Genie following publication of an updated Policy shall be subject to the revised Policy in retrospective, to the extent permitted by applicable law.
- GOVERNING LAW
- This Policy shall be governed by and construed in accordance with the laws of India.
- Any dispute arising in connection with this Policy shall be subject to the applicable laws and jurisdiction of the competent courts and authorities in India, subject always to any mandatory rights or remedies available to Users under applicable law.
